Bond has been amended for an Artesia man being detained at the Eddy County Detention Center on charges of incest, criminal sexual penetration of a child and 42 counts of criminal sexual contact.

A Fifth Judicial District Court Judge ordered the bond for Michael Brown, 36, to be changed from a $25,000 cash or surety to a $25,000 appearance bond.

Assistant District Attorney Lesley S. Williams said the difference between the two bond types is cash or surety bonds stipulate the defendant must post money or collateral before being released and an appearance bond is only paid if the defendant fails to appear in court.

Williams said the move will likely result in Brown’s release from the ECDC very soon. He said the terms put forth by the judge mandate Brown wear a G.P.S. ankle monitor at all times, adding Brown will be allowed to venture from his house only to attend work or meet with his lawyer. In addition, any form of contact between Brown and the alleged victims will be strictly prohibited.
