Daniel Aguilera of Artesia was bound over to Fifth Judicial District Court Wednesday on charges relating to the July 5 shooting incident that led to the death of a 27-year-old Artesia man and the wounding of another.

Aguilera, 20, appeared Wednesday afternoon before Judge Daniel Reyes Jr. in Artesia Magistrate Court, both in person and through counsel Debra Lautenschlager. Robert Perozynski II represented the state.

The defendant was bound over on charges of second-degree murder (a second-degree felony) and aggravated battery with a deadly weapon (a third-degree felony). Those charges were amended from the charges filed at the time of his arrest Sept. 7 of murder and attempt to commit a felony, to wit: murder.

Aguilera stands accused of the shooting death of Andres Rojo, 27, on July 5 in the 1400 block of Yucca Avenue and the injury of Rojo’s 23-year-old brother, Luis Rojo.

A trial date has not been set.
